TVM Lawsuit Update: Second Trial Against Boston Scientific Begins in Massachusetts
On August 14, the second bellwether trial against Boston Scientific began in the Massachusetts state court consolidated litigation. The trial involves allegations by plaintiff Maria Cardenas that the Boston Scientific transvaginal mesh (TVM) product she was implanted with caused her serious injuries. (Cardenas v. Boston Scientific Corp., Case No. 12-02912, Superior Court of the Commonwealth of Massachusetts, County of Middlesex).
This will be the second trial involving Boston Scientific that has occurred in Massachusetts state court. The first case against Boston Scientific resulted in a defense verdict in favor of Boston Scientific on July 29, 2014. (Albright v. Boston Scientific Corp., Case No. 12-909, Superior Court of the Commonwealth of Massachusetts, County of Middlesex). Following nearly a three-week trial, the majority of jurors decided that plaintiff received adequate informed consent regarding the risks associated with the TVM device manufactured by Boston Scientific.
Boston Scientific is facing thousands of other claims involving their TVM devices. Nearly 12,200 of those claims against Boston Scientific have been consolidated in a Multidistrict Litigation (In re: Boston Scientific Corp. Pelvic Repair System Products Liability Litigation, MDL 2326) before The Honorable Judge Joseph R. Goodwin in the United States District Court for the Southern District of West Virginia. The first federal trial in MDL 2326 is scheduled for November 3, 2014. In Massachusetts state court, there are nearly 1,700 claims still pending. Thousands of women allege that they have experienced complications from these TVM devices, including device erosion, organ perforation, intense pain, inability to have sexual intercourse, infection, and the need to undergo multiple revision surgeries.
