Kristine KraftA recent exposé by The Huffington Post, titled Side Effects May Include Death: The Story of the Biggest Advance in Birth Control Since the Pill, discusses the dangers allegedly posed by NuvaRing®, one of the most popular forms of birth control in the world.

More than 2,000 cases are currently pending in the United States District Court in the Eastern District of Missouri as a part of the In re NuvaRing® Products Liability Litigation, 4:08-md-1964, MDL No. 1964 before Judge Rodney Sippel.  These Plaintiffs are suing the manufacturers of NuvaRing®, alleging that the product was defectively designed, contains inadequate warnings, and increases women’s risk of blood clots, stroke, and even death.  A Huffington Post article published on December 18, 2013, titled Side Effects May Include Death: The Story of the Biggest Advance in Birth Control Since the Pill, speaks with one of the attorneys pursuing claims on behalf of women allegedly injured by NuvaRing®.

Kristine Kraft, an attorney with Schlichter, Bogard & Denton, LLP, is serving as co-lead counsel in the NuvaRing® Multidistrict Litigation (MDL 1964).  In these causes of action, Kraft contends that Organon was aware that data showed NuvaRing® to be unreasonably dangerous, both due to the type of hormone used in the popular contraceptive, and the product’s delivery system.  Specifically, the lawsuits allege that the hormones present in NuvaRing® cause an increased risk of blood clots compared to other hormonal birth control products, and that the vaginal ring delivery system releases bursts of estrogen instead of delivering a steady dose.  However, Kraft alleges, this information was effectively covered up by Organon.

“Was it provided to the FDA?  Yes.  But do you know how big a new drug application is?  It’s volumes and volumes,” Kraft explains to The Huffington Post.  “So it’s buried in that data, it’s not in the summary.  They did not footnote anything about the burst of estrogen being detected in these individual subjects of this study.  It is, in our view, misleading.”

The Huffington Post article profiles the story of Lyndsey Agresta, one of the many women represented by Kraft in her suits against the manufacturers of NuvaRing®.  The case currently is pending in the United States District Court for the Eastern District of Missouri, titled Agresta v. Organon, USA, Inc., 4:10-cv-1482.  As described in the article, Lyndsey started suffering migraines after she began using NuvaRing®.  These migraines worsened to the point that she sought medical attention.  Doctors learned that Lyndsey had a blood clot, which in turn caused a brain hemorrhage and massive stroke.  Lyndsey died at age 27, leaving behind a 5 year old son.

Kraft has filed causes of action against Merck, Organon, and Schering-Plough in the In re NuvaRing® Products Liability Litigation lawsuits, seeking damages on behalf of Lyndsey, and the many women like her, who allege that they were injured as a result of using NuvaRing®.
