GranuFlo® Lawsuit Update: Over Two Hundred Lawsuits Filed in MDL 2428 Pending in Federal Court
Nationwide, hundreds of lawsuits have been filed against Fresenius Medical Care for inadequate warnings about risks associated with GranuFlo® and NaturaLyte®. In March, the Judicial Panel on Multidistrict Litigation (JPML) announced that all GranuFlo® federal lawsuits would be consolidated for pretrial proceedings before the Honorable Judge Douglas P. Woodlock in the United States District Court for the Northern District of Massachusetts (MDL 2428). Since that time, over two hundred lawsuits have been filed in the GranuFlo® Multidistrict Litigation, according to the most recent case list released by the JPML on August 15th. Plaintiffs in these lawsuits allege serious injuries, including heart attacks, strokes, and even death, as a result of using GranuFlo®.
GranuFlo®, along with NaturaLyte®, is an acid concentrate diluted to clean a patient’s blood during dialysis treatment. Plaintiffs allege that the formula used with these drugs interferes with the bicarbonate conversion process, resulting in an amount of bicarbonate (a carbonic acid salt) that exceeds the amount prescribed by the doctor. Plaintiffs also allege that Fresenius failed to adequately warn dialysis patients and medical providers about these problems. The U.S. Food and Drug Administration (FDA) issued a Class I Recall of the drug in 2012 after a whistleblower leaked an internal memo to the FDA. The internal memo revealed Fresenius had conducted an internal study in 2010 and found that 941 patients in one-third of its clinics suffered cardiac arrest during dialysis treatments involving GranuFlo® or NaturaLyte®. The company concluded that these patients, with high levels of bicarbonate in their blood, had about six times the risk of cardiac arrest as those with lower levels.
